INC-29: Integrated e-Form for Incorporation of Company in India

The Ministry of Corporate Affairs has introduced a new integrated e-form INC-29 w.e.t 1st May. 2015. 
INC-29 will be available for incorporating of companies other than section 8 companies and will accommodate applications for up to three new DIN applicants who will be Directors of the company being incorporated. 

In addition e-Forms INC-30 and INC-31 are also being made available for the purposes of Memorandum of Association (MoA) and Articles of Association (AoA) to be attached with INC-29. 

The Instruction kit for filling the e-forms INC-29. INC-30 and INC 31 may be accessed on the MCA21 portal. 
Standalone e-Forms DIR-3. INC-1 and INC-2 or INC-7 for DIN, Name Reservation and Incorporation of a company will continue to be available as before for stakeholders wanting to avail these services separately.

Purpose of the eForm –

eForm INC-29 deals with the single application for reservation of name, incorporation of a new company and/or application for allotment of DIN. This eForm is accompanied by supporting documents including details of Directors & subscribers, MoA and AoA etc. Once the eForm is processed and found complete, company would registered and CIN would be allocated. Also DINs gets issued to the proposed Directors who do not have a valid DIN. Maximum three Directors are allowed for using this integrated form for allotment of DIN while  incorporating a company.

INC-29 is a Integrated incorporation Form and will provide applicants a facility to avail of the following services through a single e-form.

1. Allotment of Director Identification No. (DIN) (Max. 3 Directors)
2. Name of a Company; and
3. Incorporation of Company.

MANDATORY ATTACHMENTS:

• Memorandum of association

• Proof of Office address (Conveyance/ Lease deed/ Rent Agreement etc. along with rent receipts);
• Copy of the utility bills (not older than two months)

NOTE:

• The e-Form will not be auto approved (STP).
• Companies have option to go by route of e-form INC-29 or earlier route INC-1, INC-7, DIR-12 and INC-22.
• Director has to give declaration at the end of the form that he have check the name on MCA website and Trade Mark Website.
• DSC of Director will be affix on form. {In case of director don’t have DIN then mention PAN No. of director at the place of affixing of DSC)
• DSC of professional will also affix on the form.
